MB bluetec lawsuit in USA

My recent AEM service went poorly, to keep a long story short. Even with the extended warranty, which will protect things like the turbo and timing chain, I strongly encourage the selection of a different vehicle that is easier to service and is more reliable. Diesel has also unfortunately risen, negating any cost savings. YMMV.
I also cannot get data back from my Foxwell NT510 Elite scan tool. It used to be able to see data but doesn't any more. Maybe there will be an update.

It does have the tubes that lead into the DPF. There is no DEF tank. MB does not provide a replacement DPF once it is carbonized. I have a car that now is illegal in the state of California if I replace the DPF with a straight(with non-functioning DEF tubes) pipe and apparently there is no solution to fix this POS car.
This is US distributor for Polish manufacturer, so there is lot to get in Poland. The new DPF might not have CA certification due to low sale potential, but I contacted them and they would pass, so I don't think with CA smog technician doing visual check that would be an issue.

Seems everyone's experience is different. Makes sense given different operating conditions, and different levels of dealer competence with the diesel engines, at least in the US. We're fortunate to live near a very large high volume dealership that sees a lot of diesels. We're not in California, so don't have to worry about that nonsense. We have an '08 E320 bluetec, '12 S350 bluetec, and '15 GL350 bluetec. All three have been stellar and no plans to get rid of them any time soon. The S is mine, the GL is the wife's kid hauler, both are comfortable and powerful, and deliver far better MPG than a comparable gasoline model. On a recent road trip, the on board computer showed 35.9 mpg in the S350, really remarkable for a 4000+ lb car.
We've had some repairs and such, but I'm a DIY'er and the om642 is fairly DIY friendly. Oil cooler seals, swirl flap motor, torching the gunk out of the intake manifolds, etc. Other than that, just routine maintenance. The GL did need a timing chain at around 80k, but was covered by the dealer 100% under the emissions settlement. The GL got the recall work done in early 2021, no issues with parts availability, and a new DPF is included. I've opted not to have the recall work done on the S. I've also switched to a 5k oil change interval to better match our driving profile. Keep on dieseling!

Sorry not recall but the extended modification warranty. Leaking oil does cause pollution i guess lol. regardless it covers things like timing chain, turbo charger, cylinder head assembly components like camshafts, valves, springs, etc etc. id argue that the well known oil cooler seal problem should be included in the AEM extended warranty vs warrantying valve spring keepers...

Had AEM done back on 4/7/21 received my check for $3,590 yesterday. I have since sold that 2015 E250. It ran well after the AEM, although it did not seem quite so quick from a dead start. Also, I thought I noticed some minor deterioration in mpg, about 2-3 mpg. One check down, two to go. Still waiting on check for 2014 GLK250 and still have a 2014 E250 needing AEM. All the cars are low mileage under 60K miles. I'm nervous about getting the AEM done to the last one. Love the car at 55,000 miles in Maine. The first two AEM's went fine, but sometimes things don't work out as some of you know. I had my last Mercedes E320 for twenty years and hope to keep the 2014 E250 that long.

My 2014 GL350 Bluetec has been diagnosed by the dealer as having spun either a rod or main bearing with 125K miles while driving at a constant speed on the highway at 75 mph. (I don't know which, but the internal engine knocking from the underside of the car is quite loud.) I bought the car new, and every oil change and maintenance requirement has been performed by the dealer on schedule, as this is the car we hoped to drive for another 125K miles. The car has never been driven in high water or abused in any way and easily 1/2 of the miles are highway miles. Now, the engine is filled with metal shavings and it is considered junk by the dealer. Obviously, it is not worth repairing. Does anyone have a similar experience? What are my options? Does anyone reliably rebuild and exchange these engines?

Unfortunately OM642 engines proved to have very strange chemistry, who turns inadequate oils into gelatin and several engines seized due to the phenomena.
Check your maintenance receipts if they list the oil used and have fun reading the long topic.
Sorry it happen, but too many owners takes dealer service as guaranteed to be good.
It ain't so.

Thanks, great heads up. I have checked, and the invoices specifically say, "BMEU MB 229.52 SAE 5W30 Bulk". Assuming this is accurate, that is the oil that they are supposed to use, correct?

229.52 would be correct oil, but to my knowledge, it was not available in bulk.
Would my original car blow the engine under dealer care, I would definitely check everything with magnifying glass and contact MB hotline for advise. while sending oil sample for lab test.
MB engines don't blow just because.

I agree, as do all of the MB service techs I've talked to. That is great advice. I have opened a case with MBUSA. We'll see where that goes. Whether the service is "good" or not, at least there's no fingers to point anywhere else.

One thing for sure about the people administering the lawsuit is they are at best scattered and at worst incompetent. They can't seem to keep track of the paperwork I have already sent them 3 times and never give clear answers. This has been going on for a long time. No checks or confirmations yet.

Email them at info@MBBlueTecSettlement.com and insist on checking the files. There is a lady name Shery, who actually helps to check the status and answers emails.

I did what you are recommending and got a generic response. I gave them dates, and claim numbers, and here is what I received back. It has been over a year since I filed my claim.

Well after it being pretty much a year since i submitted all the paperwork, they finally sent me a letter in the mail a year later saying they were missing the individual release document. It's in my folder with all my other documents signed from a year ago but its the only one that was a pdf instead of jpg. Wondering if it didn't upload correctly...
Hopefully it went through the second time around. I should probably print it out and hand mail it too just in case or maybe that will confuse them...

Seems the law office is fooling around when after a year they inform you that you are missing documents. Per most reports, they do have the required papers, so something is wrong.
In my case I mentioned above, I emailed them the proof of ownership again, they confirmed receiving it and now they send me paper note that they are stil missing it.
I send them another email several days ago and no response.
I made a typo above. The person who is good in answering the emails is

I had the AEM done last fall. My E250 just averaged 42mpg on a 1300 mile drive from Florida. I'd say fuel economy was not impacted by the AEM - that is typical for this car and that drive.
The car just threw a check engine light. It was the DEF heater element. Dealer changed it under warranty. Whether that issue was caused by the AEM isn't clear, but somehow I doubt it. I believe the AEM warranty is a positive, I'm sure that would have been a few thousand dollars if it wasn't covered.
I'll probably keep this car for another set of tires while I have the warranty. Sitting at ~130K miles now.
