The key way got sheared off after test run of the asp pulley install.
1900 worth of damage don

How is that your fault? Their install failed, that is the whole point of paying someone else to do it isn't it? So it is done "right" and if there is a problem, they are liable.

They are saying since it is not and oem part we are not responsible for the repair.

I don't know how much a lawyer would cost for something like this, but I would look in to one since $1900 isn't exactly pocket change. You bring your car to a "professional" for work and then they don't warranty their work. It is not smoke and mirrors, it is a pulley that needs to be properly torqued down with one single bolt, and they failed to do it right and should be held responsible.

Did you sign any kind of paperwork saying I take responsibility for anything with this "repair" because it is not an oem part?

No i did not, there argument is that since I brought the part to them which is a after market part. All they can do is discount the labor from 130 tp 90

That is just not right man, thats BS if you ask me. Let me get this straight, you take your aftermarket pulley to a certfied MB tech, have them install it. They install it, and when you take the car out for a test ride, it comes loose immediatly and shears the keyway?

Let me ask you this question, did the pulley you put on have an OEM MB hub?

I had a feeling that this would happen w non mb part. Sorry to hear this. The torque specs used was for smaller pulleys???

It sounds like he didn't even have the car back, that the tech/dealer was taking the car for test ride and it failed. Could be wrong, but either way, I don't see how they aren't liable, especially if nothing was signed saying they weren't responsible and agreed.

If they accepted the job without stating that they would not be liable do to the pulley being an aftermarket part then it's their loss.

Regardless, this same thing happened to me and I fixed it nearly free. Search under my user name for pulley.

I know it's chawkins2001,

I didn't even take it out for a test run the mb tech did. He called me and told me that the pulley fell off.

As far as the oem hub is concerned I don't think he did anything there, I gave him the asp pulley and the bolt along with the sc and idler pulley's.
There was no mention of hub anywhere in the conversation that him and I had.
Should I say something to him that he might have missed?

I'm sure it was a oem hub

I really hope it works out, but here are my thoughts.......
Short of getting the district manager for the dealer involved, the dealer should have never agreed to do that work. AFAIK dealers will not install aftermarket parts. Calling MBUSA will only reveal that this is an issue between you and the dealer. Yes you were wrong, but unless you have the suffix ESQ. next to your name, nothing will be resolved in your favor.

The shortcut is to do the following.
1. Get all your paperwork and documentation together and hire a Lawyer
2. Pay an indi to install/fix your car and provide those invoices to that same lawyer.
3. Dont rely on that dealership to resolve anything for you. Their paperwork protects them. Don't bother with finding a way to getting it resolved. They will only help themselves. They see you as a fourth or fifth generation owner of a ten year old car and would prefer you went away quietly.
4. Hope your lawyer will get your costs back and can settle out of court.

Im just trying to help you save time and understand the rationale behind their thinking.
Been there before.
The dealer holds all the cards.

You won't win this battle....Just accept it, find a great independent MB tech, fix the problem correctly, and move on....$1900 is not pocket change, but if you have an e55, things can get much more expensive once you start modifying....Heck things can get much more expensive just plain stock....

I agree with you 100% moosejaw, the car is undrivable at the moment I am going there to have an argument with the manager and threaten with a lawyer.
The tech is some what a friend and I don't want to get him fired in the process.

Well so far they said they would give me a discount rate and when I go there I will haggle with the mng more to drop some more off

The problem is the tech didnt torque the pulley to the correct specs per the op's other thread..

the tech told the op that he torqued it to 190+ 90 which is way off the ASP/EC recommended torque spec of 275 +90.

this is def the techs fault for not using the correct tq spec on the pulley bolt... i think the op has the right to have the shop fix it free of charge since it is there fault for not installing it correctly

the same thing happened to me when an indy shop (malones automotive) installed mine.... luckily no damage was done to my crankshaft and i was able to take it to BIP and they fixed me up good

that sux!

a similar thing just happened to my Targa: had a dealer put in a AM horn......turns out it
was installed wrong and fried a board of some type......but they did not even hesitate to have it all taken care of......
kudos to them for that...

the dealer you went to should seriously man up and do the right thing......

Was your key way stuck in the crank shaft gaspam? And how did they get it out? That is where all the labor is costing the most, they have to take most of the front part of the engine to get in the crank shaft to take out the key way
