Well... here's what happened.
My CEL came on... (perhaps my nose is dull and I couldn't smell anything...)
I take my car to the dealership and they run tests all day, and my SA tells me "Fuel pump / fuel sending unit", needs to be worked on but it would cost approx $2800.
I inquired if it is covered under the fuel leak issue... and the dealership is saying no... because of the fact that I brought the car in because of "CEL illuminated".
They are still checking on it...
What are your thoughts?

The CEL is on for a reason. It would take 5 seconds to check what it's on for. If it's on for let's say a fuel cap not properly closed then I would say it has nothing to do with the smell problem and they should do the work under the warranty.
So once you have all the facts together let us know and I'm sure one of the other member can elaborate on whether it's a legit turn down or not of the warranty claim.

It doesn't matter why you brought it in. If the fuel system is leaking fuel or has fuel stink, they must fix it! The dealer is trying to weasel out of sticking their Mercedes overlords with another repair bill.

It's 7am now and I'm st the dealership to address this issue with shop foreman and the "warranty writer" to rectify the whole situation.

It was just so hard to believe that I had to convince the fact that fuel sender, pump is part of fuel components as states in the letter sent from NHSTA to MB.... I still have to talk to the foreman and warranty writer but it's just so frustrating...

Trust me. Been there. We had to go back twice and even involve MBUSA. Too many lazy people there plus the fact that they only collect a paycheck and don't like to know current affairs to help customers is the problem.

Read through this thread. Ask them to pull your car's info in VMI. If it stays "tank" then you need a brand new tank/sender/pump. If it says "fuel components", then they warranty only individual failed components (such as the fuel sender).
In this thread there is the repair instructions that Mercedes dealers use, and it's completely explicit on what they should do. Give them that repair flowchart, and if they still baulk then file a claim/complaint with the NHTSA and explain what's going on.

Still waiting... Last I spoke to the SA, he said if anything they will replace everything... I'm hoping for that.

I got the code for P0456 today on the way in to work. Contacted the local dealer about the letter posted earlier.
I have an appointment on Monday to drop off the car and have the fuel tank and such replaced under the extended 15 year warranty. No cost out of the pocket.

When I took mine in and they said they had the tank in stock, they actually only had the 350 tank. So they did end up having to order the new tank and said it would likely take a few weeks. But they didn't give me any hassle etc. I was very pleased with the service at our local dealer.

My car had the tank replaced under warranty already, I don't see anything on the paperwork saying they replaced the sender/pump. I recently noticed that it smells like fuel at times, not inside the car but outside towards the rear section of the car/where the tank is. Has anybody else experienced this? Fuel smell after the tank was already replaced under warranty, and if so have you had any trouble bringing it back to get it looked at again?

soon mine started smelling like a as station and took it in to the dealership, they said it would be replaced under the warranty.
Then i remembered that i had a set of eurocharged headers put on a couple months ago, anyone had any problems with aftermarket headers? especially those that are welded on?

I am starting to smell a strong odor of gas coming from the inside of my E55. Especially after filling up the tank. The other day I noticed a small wet spot of gasoline on my garage floor where I park my car. Does anyone know if this would this be covered on my 2003 E55 with 54k miles out in Hawaii? Any help is greatly appreciated.

Headers should not matter, as long as they can disconnect last section with mufflers and resonator.
Yes Hawaii is covered, if there a Mercedes certified shop you can bring the car to. Get it fixed, you're driving a rolling bomb.

Update: Dealership called and told me that the parts came in. Dropped off the car last Thursday (3/17/16) and rolling around in a loaner (GLA). Surprisingly the loaner is comfortable... love the SUV trunk accessibility. Unsure when my car will be done with the repair... pending, I am in no rush.

For me, GLA was functional...
Decent amount of trunk space... Only thing that it lacked was power. It struggled in many aspects... lol
As for the appearance, it was sleek, I liked it.
Gas tank is tiny...
Great loaner... I am actually thinking about leasing one just for giggles, every day car.
I never owned a white car... always wanted one. However I didn't realize how hard it was to keep it clean. Especially here in Hawaii with red sand... dust, only downfall.
