Transmission Problem - Glycol + Possible lawsuit in Canada
I am experiencing the symptoms of glycol contamination in my transmission again. Last time i had the problem, i got the flush done and replaced the electrical plug and problem was gone. It was because of the leak and these transmissions are extremely sensitive to the fluid level and could exhibit the same symptoms as glycol contamination. However, it appears to be different this time, the level is spot on, but it smells burnt and fluid has a greenish hint to it - to me it seems like heavy oxidation..
Called up the stealership and they qouted over $800 for the proper flush (21 L of fluid) + 4 hours of labour. Oh yeah those of yous who dont know - the price of ATF has gone thru the roof...you just cant find Shell 134 anymore..and the ones who have it they are selling it at over $25/litre.
Since the last flush (over 2 years ago) the filler cap was missing for a while and then i replaced it with a filler cap but it was not sealed completely, it was missing the lock pin - do you guys think that might have caused some oxidation?
Secondly for those of you in Canada, I am seriously contemplating a class action law suit in Canada depending upon how many people are on board with this. Its worth a shot - reply and let me know if you guys are on board and then we can take it from there. I know currently there is a lawsuit in pursuit in states. No offense but I think a class action is a little late. After 9 years I think Mercedes could easily get away with saying that it was lack of maintenance or something. That said good luck

I agree, class action would be futile. Also, is the deal with Ryder Fleet changed? I know they're not selling Shell 134 for $1.91 a liter anymore but isn't it still just $5.30 or something? Try there.

i almost agree but not with the new iPhone 4s, it is not $399 but $159 with a contract thru rogers. Well at least in Toronto it is.

I agree with you guys some what about the law suit and yes they could say it is due to poor maintenance and all but when there are thousand of failures and a known design defect it is a bit hard to pull that one. Thats why it would be a class action rather than an individual suing.
Secondly its not unheard of to have recalls even after the warranty has elapsed - remember the oil in the cam sensor and wiring harness problem or the $12 vacuum hose issue. The only thing is mercedes knows this is not going to be a cheap recall for them thats why they wud do whatever they can to put it off, otherwise this problem meets all the criteria for a recall. Anyhow, its just that i am really frustrated with their BS and maybe i would feel a lil differently once my brain has cooled off a bit ..:d
Everything is 2-3 times expensive here in Canada, i wud prolly have the stuff shipped to a warehouse just south of the border near nisgarafalls and then go get it - its only hour n half commute from toronto. For fellow canadians, there is a warehouse in niagarafalls/US that lets you ship your US purchases to them for i think $5 and then you can go and pick up ur stuff from there. I will look for the name of this warehouse and post it.
